This website is operated by MGB Gift Store (MysteryGiftBag), a sole trader business. Our principal place of business is in the United Kingdom.

2. Acceptance of Terms

By accessing or using our website and services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part, you may not access or use the site.

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age, or
  • Be between 13 and 17 years of age and have the consent of a parent or guardian.
  • Agree not to use our site for any illegal or unauthorised purpose.

4. Account & Billing

You agree to provide accurate and complete information. You are responsible for all activities under your account. We reserve the right to refuse service or cancel orders at our discretion.

5. Product Information

We strive to display product colours and images accurately but cannot guarantee your monitor’s display. All products are subject to availability. Mystery Scoops, Mystery Bags, and all other surprise-style products are sold on a random, "as is" basis. By purchasing, you acknowledge and accept the inherent uncertainty of the contents. These, along with all personalised/customised products, are final sale.

6. Pricing & Payment

  • All initial prices are in British Pounds (£).
  • International Orders: The price displayed at checkout for international orders includes the product cost and international shipping fees. Please note that it does NOT include any potential customs duties, import taxes, or additional fees imposed by the destination country. The customer is solely responsible for paying these charges to the relevant authorities upon delivery (Not applicable to UK, USA, EU & India).
  • Prices are subject to change without notice.
  • Payment is processed securely via our supported payment gateways.

7. Orders

We reserve the right to limit or cancel orders. You may only cancel an order before it has been dispatched.

8. Shipping & Delivery

  • All initial prices are in British Pounds (£).
  • UK Orders: Processed within 1-5 business days. Standard delivery typically takes 3-7 business days. Expedited delivery typically takes 1-3 business days.
  • International Orders: Processed within 3-7 business days. Delivery times vary (typically 15-30 business days) and are estimates only. We are not liable for carrier delays.
  • Customer's Responsibility: You are responsible for providing an accurate and deliverable shipping address. We are not liable for orders lost due to an incorrect or incomplete address provided by you.
  • Risk & Title: Ownership of the goods passes to you upon delivery. We are not liable for packages lost, stolen, or damaged after handover to the carrier but will assist in filing claims where possible.
  • You must report any non-delivery or obvious external damage to the carrier within 48 hours of the expected delivery date.

9. Returns, Refunds & Your Legal Rights

A. Your Statutory Rights (For Faulty, Damaged, or Not-as-Described Goods)

Your statutory rights are not affected by our policy. Under the UK Consumer Rights Act 2015, you are entitled to a refund, repair, or replacement for goods that are faulty, damaged upon arrival, or not as described. **You must report such issues to us via email at mysterygiftbag@gmail.com within 48 hours of delivery, providing clear photographic evidence.

B. Change of Mind Returns & Refunds (UK & EU Customers Only)

Under the UK Consumer Contracts Regulations 2013, you have 14 days from the date of delivery to cancel your order for any reason. To be eligible:

  • Items must be returned unused, unopened, and in their original, saleable packaging with all tags attached.
  • You are responsible for the cost of return shipping.
  • The original outbound shipping cost is non-refundable.
  • A handling/restocking fee may be deducted from your refund.
  • If returned items are not in original condition, we reserve the right to refuse the return or issue a partial refund.

C. International Orders (Outside UK & EU) – Final Sale

For change of mind, **all international orders outside the UK and EU are final sale.** We do not accept returns, exchanges, or provide refunds. This does not affect your statutory rights for faulty, damaged, or misdescribed goods as outlined in section 9A.

D. Non-Returnable Items (All Customers)

The following are **final sale** and **non-refundable** under any change of mind or dislike returns: **Mystery Scoops / Lucky Dip Bags, flash sale items, personalised/customised items, digital products (e.g., video add-ons), perishable goods, and items marked as final sale.

10. Optional Tools

We may provide access to third-party tools “as is” without any warranty, endorsement, or liability. Your use of such tools is at your own risk.

11. Intellectual Property

All content on this website (including text, graphics, logos, and images) is our property or licensed to us and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

12. User Comments & Content

By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and publish it. You warrant that your comments are original, do not violate any third-party rights, and contain no unlawful, abusive, or obscene material.

13. Prohibited Uses

You are prohibited from using the site for any unlawful purpose, to infringe upon our or any third party's intellectual property, or to transmit malicious code, such as viruses.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders at any time without prior notice.

16. Disclaimer of Warranties; Limitation of Liability

Your use of the service is at your sole risk. The service is provided ‘as is’ and ‘as available’ without any warranties of merchantability or fitness for a particular purpose. **To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the service.

17. Force Majeure

We shall not be held liable for any failure or delay in performance of our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.

You agree to indemnify and hold harmless MysteryGiftBag and its operator from any claims, damages, liabilities, and expenses (including legal fees) arising from your breach of these Terms or your use of the service.
